A Contractor's RFI form has lines for "Cost Impact" and "Schedule Impact." These lines are always filled out with "Potential" to the point that I think it's actually the default for their template. Presumably this is intended to fulfill the notice requirements of the Contract although I'm not sure how it would fare in the Courts if challenged. We've seen similar language recently from 3 or 4 different Contractors. In the past, I've insisted that those lines be removed from the Contractor's form on the grounds that they cannot possibly know if there's a cost or schedule impact in advance of our response. However, lately Contractors appear to be loathe to revise their forms and the push back has intensified. Are others seeing this kind of behavior, and, if so, how are you responding? In this case, this is a quality Contractor and this project is going well, but it does seem to be a trend and, unfortunately, the time will come when we're dealing with a different Contractor and this could end up being an issue. |
