Perhaps the text should be there so they know in advance what they'll have to agree to. This follows the Masterspec arrangement, if I recollect. The AIA forms seem to cover the ground very well; it may not be necessary to reinvent the wheel. These forms are in the current electronic documents subscription. Anonymous   Posted on Tuesday, July 08, 2008 - 03:19 pm:    As John indicates, I also generally cite the need in submittals section...but also reference a separate, more legalese document that I don't attach. I don't think that it is "essential" part of Contract Documents and as such can be executed "outside" of the contractual confines of same. Robin - Just a note of caution; such a "legal" document should come from (or at least have been reviewed by) your A/E client's legal counsel..although, you could offer "examples". As a sidenote, AIA C106 could also be used as a starting basis, but I feel that it could/should be "expanded". I simply think this is a more complicated issue than everyone seems to make it out to be -- its not just turning over electronic documents -- its making sure the versions are current, the information is updated, and then properly translated (if that is necessary, and it often is) to formats usable by subcontractors. I also agree that the Masterspec new docs and the AIA new document is pretty useful, in general.
