[moved from other forum] joel - Guest I would say yes, but wouldn't it be like a de-facto compliance in that there has to be some sort of light switch/thermostat in there anyway (i.e. 100% control)??? Verifation is a stickier issue... maybe the tenant could just put a note to ask himself how it feels 6-18 months after construction? I imagine the "plan for corrective action" would be pretty simple.
