Do any of you have language in your spec that incentivizes the contractor to have the majority of punch list items complete prior to calling for a walk through or to penalize the contractor who thinks the purpose of the walk through is for you to generate a punch list? Or how to penalize the contractor when after the punch list has been generated, at the walk through many items are not complete? |

Below is my standard language included in Supplementary Conditions to AIA A201-2007: Add the following clause to Section 9.8.3. 9.8.3.1 Except with the consent of the Owner, the Architect will perform no more than 2 inspections to determine whether the Work or a designated portion thereof has attained Substantial Completion in accordance with the Contract Documents. The Owner is entitled to deduct from the Contract Sum amounts paid to the Architect for any additional inspections. Add the following clause to Section 9.10.1. 9.10.1.1 Except with the consent of the Owner, the Architect will perform no more than 2 inspections to determine whether the Work or a designated portion thereof has attained Final Completion in accordance with the Contract Documents. The Owner is entitled to deduct from the Contract Sum amounts paid to the Architect for any additional inspections. |

I too have similar language but in Div 01 closeout procedures section, where added inspections (beyond initial and one re-inspection) are reimbursed at 2-1/2 times direct (architect's) personnel expense rates. Except my language is silent on method of reimbursement. |
