Recently, AWI’s Technical Committee released 4 clarifications for the Architectural Woodwork Standards Edition 2, two of which function as errata, despite AWI’s disclaimer that they are not errata. Unfortunately, this has the potential to cause liability issues for those who build cabinets and rely on the clarifications. The two clarifications at issue are:
• Item 10.4.7.16.9.5 The interpretation shall be that metal shelf standards shall extend vertically to within 6” of the top or bottom of the cabinet shelf space.
• Item 10.4.7.10.5.2 This item results from a conflict in the requirements for visible and concealed surfaces. Therefore, edgebanding may be applied or omitted at the option of the manufacturer.
When the Joint Standards Committee was in existence there was a process which allowed for issues to be addressed, corrected and adopted such as errata if necessary. In following this process, these errata were recognized as legally enforceable changes to the AWS, 2nd edition.
Clarifications (even if acting as errata) can no longer benefit from this process because of the dissolution of the JSC.
The true harm is that a millwork firm relying on these clarification, may build cabinets according to these clarifications, yet the architect could enforce the AWS 2nd edition, thereby exposing the firm to potential liability.
