Are there any legal ramifications when an architect uses manufacturer specs word for word on his drawings, other than copyright?

The architect of record is responsible for the documents that are issued under her/his seal. I don't see that an architect would have much legal traction arguing that she/he relied solely on the manufacturer's specifications without doing her/his own due diligence.

Agreed Dave. I don't know how many manufacturers I would trust with that sort of weapon no matter how good or honest they are unless they are sealing the documents that they are generating.

Why would it be any different to use manufacturers' specifications on drawings?

I can't figure out why manufacturers copyright their product information. Some go further, specifically prohibiting use of even the specifications! So you want me to specify your product, but you won't let me use your specs?

Even if the specs do not bear a copyright, most websites have something like this:

Except as expressly provided herein, none of the material provided on the Website may be copied, distributed, republished, reproduced, downloaded, displayed or transmitted in any form for commercial use without the prior written permission of [the manufacturer].

When I write manufacturer guide specs, I include a note,

"Copyright XXXX by [the manufacturer]. Qualified design and construction professionals may copy for preparation of construction specifications or purchase orders."
